Termination, Contract End & Deletion

1. Termination by the User
The user can terminate paid subscriptions at any time via their user account or the provided cancellation channels.
Termination takes effect at the end of the currently running contract period. Paid fees are generally not refunded, unless mandatory legal provisions state otherwise.
Free services can be discontinued or deleted at any time without notice.
2. Termination by WeSendit
WeSendit is entitled to terminate the contract ordinarily under observance of a reasonable period.
The right to extraordinary and immediate termination for important reasons remains unaffected.
An important reason exists in particular if: the user violates these GTC or other binding policies of WeSendit; rights of third parties are violated; services are used abusively or in a security-threatening manner; legal or official requirements make continuation of the contract relationship unreasonable; due compensation is not paid despite a warning.
3. Product and Subscription Adjustments
WeSendit continuously develops its services and reserves the right to adapt, merge, or discontinue products, service scopes, feature packages, storage quotas, pricing structures, and subscription models at any time.
If such an adjustment affects existing paid subscriptions, the affected user will be informed in due time. Notification will be in an appropriate form, in particular via email, within the user account, or via other electronic communication channels.
If an existing subscription is discontinued or significantly modified, WeSendit is entitled to migrate the user to an equivalent or higher-value follow-up subscription. The modified services and the future prices will be communicated transparently.
From the date of notification, the user receives an extraordinary termination right. The user can terminate the affected subscription up until the changes take effect.
If the user does not object to the announced adjustment within the notified period or continues to use the services after the adjustment takes effect, this is deemed as consent to the migration to the new subscription model.
Automatic migration occurs solely for the purpose of maintaining service delivery and does not establish a claim to the preservation of historical products, prices, or performance scopes.
4. Consequences of Contract Termination
Upon termination of the contract, the user's right to use the affected services ends.
WeSendit is entitled to deactivate access to user accounts, storage areas, sharing functions, Branding Channels, and other provided services.
To the extent technically possible and economically reasonable, the user can be granted a reasonable period to save or export their data before final deletion.
There is no claim to the provision of specific export formats or migration services, unless expressly agreed otherwise.
5. Deletion of Data
After termination of the contract, WeSendit can delete all stored content and associated metadata, provided no legal retention obligations, official orders, or legitimate interests prevent this.
The user is solely responsible for backing up all relevant data before termination of the contract.
WeSendit assumes no liability for data loss resulting from the user's failure to back up their data.
6. Continued Validity of Individual Provisions
Provisions on liability, data protection, confidentiality, intellectual property, trademark rights, indemnifications, and other regulations that by their purpose are intended to survive termination shall remain effective after contract termination.
